What is probation?
Probation refers to giving an offender the opportunity to adapt to society without postponing, imprisoning or confining him to an institution. Correction of crimes committed by the probation officer under the supervision of the probation officer and in his family and social environment by the court order not to put the juvenile or juvenile or any other adult person in conflict or law in the first and minor offense in the first and minor offense in the probation system. He was given the opportunity to integrate socially.
Probation is an informal and social reform program. It is a well-controlled action mechanism for the correction of disorderly and illegal behavior of the offender. Here the criminal is helped to prevent recidivism and to grow as a law-abiding citizen.
Under the Probation of Offenders Ordinance, 1 (as amended in section 4), the court may grant probation for 1 (one) to 3 (three) years subject to the condition of a juvenile juvenile or adult person involved in first and minor offenses. However, the legal benefit for children and teens takes precedence.
Under the Children's Act 20, adolescents have access to probation through the juvenile court.
Under the above two laws, probation officers of the Directorate of Social Services are tasked to assist wise judges, to see if the terms and conditions of the court are being complied with, and to conduct supervision and correctional activities.
How to get access?
Granting probation is essentially a voluntary power of the wise court.
After the formality of the proceedings in the probation system, a person may be considered to be guilty of law or if the person confesses, then the court may be adjudicated to have the opportunity to enter the learned court.
If the court deems it appropriate that the offender can benefit from his correction and rehabilitation by complying with the terms of the probation order under the law, the probation officer assigned to the court shall investigate the character, ex-family identity, family background and information or conditions to a pre-sentence report court. Request to be submitted
If the probation officer understands that there is scope for criminal or social-based correction in the investigation, he recommends entry. Otherwise the offender has to get peace.
The wise court may also allow self-initiation probation by reviewing the documents and the overall status of the case.
